Severance Pay (Abfindung) at Deutsche Bahn 2026: Job Cuts & Your Rights
Deutsche Bahn has not published a severance formula. In practice, the common rule of thumb is 0.5 gross monthly salaries per year of service, though there is no legal entitlement to this. As a pure illustration: on a gross salary of €5,200 and 16 years of service, this formula gives around €41,600. What is realistically negotiable in your case depends mainly on whether you fall under the protection against dismissal granted by the EVG collective agreements. If you do, Deutsche Bahn needs your signature, and that is your leverage.

Job Cuts at Deutsche Bahn: What’s Happening Right Now?
Deutsche Bahn is cutting jobs in overhead functions, meaning administration and internal service providers, while hiring in parallel for operational roles. The group describes the cuts as socially responsible and explicitly names natural staff turnover, partial retirement, and severance pay as its tools, alongside placement through its internal job market and the “Job-Neustart” programme. Around 20,000 new hires are planned for 2026, including 5,200 apprentices and dual-study students; the group says the restructuring process ran as planned in the first half of 2026 (DB interim report 2026).
Deutsche Bahn has not given an overall figure for the group-wide job cuts. The up to 30,000 jobs circulating in media reports come from DB Systel’s central works council, not from the group itself (hessenschau, 25 February 2026). What is confirmed and named, however, is the cut at the top: in group management, at least 30% of roles are set to go, along with an entire management layer between the executive board and management. According to the group, group management comprises around 3,500 people. This was stated by supervisory board chairman Werner Gatzer in January 2026 (ZDFheute, 22 January 2026).
Which Areas Are Affected
Group management and administration: this is where the focus lies. The cuts affect management and overhead functions, not the operational areas where hiring continues in parallel.
DB Systel (IT): According to the central works council, around 1,400 of the 6,700 full-time positions are set to go, nearly one in five. Frankfurt is the focus, where, according to Deutsche Bahn, around 4,100 of the 6,700 employees work; the EVG union has also protested in Berlin and Erfurt. Deutsche Bahn has not confirmed any job-cut figures and says the group wants to become leaner, faster, and more customer-focused (hessenschau).
DB Cargo: The freight subsidiary is running its own restructuring programme and has its own page: Severance Pay at DB Cargo.
Important for how you read this: a job-cut figure is not a name list. Which specific positions go and who moves on is only decided once a reconciliation of interests (Interessenausgleich) has been negotiated for your area.
Your Rights: Protection Against Dismissal, Social Plan, Termination Agreement
At Deutsche Bahn, one question comes before all others, and it decides your negotiating position: does your position fall under the EVG collective agreements? For this scope, the group describes comprehensive protection against dismissal (DB interim report 2026). If this applies to you, you cannot be dismissed for operational reasons. Ending your employment is then only possible with your signature, meaning you decide without any dismissal pressure. In non-tariff positions and group companies with their own rules, this does not apply automatically. So get your specific protection confirmed in writing before discussing any termination.
For a restructuring of this scale, the employer must negotiate a reconciliation of interests and a social plan with the works council (§ 111 BetrVG, § 112 BetrVG). The social plan compensates for economic disadvantages and sets the framework; a termination agreement offered to you individually can fall below or above it, and is negotiable.
If you are dismissed after all, the strict three-week deadline applies: your unfair dismissal claim (Kündigungsschutzklage) must reach the labour court within three weeks of receiving the dismissal (§ 4 KSchG), after which the dismissal is deemed valid, however questionable it was. If your employer offers severance pay in exchange for waiving your claim, this is the case under § 1a KSchG, with 0.5 monthly salaries per year of service as a minimum benchmark, not a ceiling.
How Much Severance Pay Can You Expect at Deutsche Bahn?
Deutsche Bahn has not published a severance formula, so here is only the common reference calculation. The rule of thumb is 0.5 gross monthly salaries per year of service. For a scenario typical of the affected administrative and IT areas, a gross salary of €5,200 and 16 years of service, this gives:
0.5 × €5,200 × 16 = €41,600 gross.
This is purely an illustrative figure, not an entitlement. Factors that push the amount up include: long service, age, severe disability, parental leave or a works council role, a questionable social selection, and, especially at Deutsche Bahn, collective-agreement protection against dismissal. If your position cannot be dismissed for operational reasons, your signature is the only way to end it. Factors that push it down include short service and a clearly justified business decision. Also factor in what you give up: allowances, travel concessions, and company pension entitlements all end with your employment, whereas an internal transfer preserves them. Work through your own case in the severance calculator, including the one-fifth rule and your net amount.
Received an Offer From Deutsche Bahn? Check It Before You Sign
You should check: your collective agreement status and the resulting protection against dismissal, the amount relative to your age and length of service, the benefit suspension period risk for unemployment benefit (§ 159 SGB III, § 158 SGB III), any waiver and settlement clauses (allowances, variable pay, company pension, travel concessions), and the tax treatment: for larger packages, the payout timing determines whether the one-fifth rule applies (§ 34 EStG). The benefit suspension period risk deserves particular attention at Deutsche Bahn: if collective-agreement protection meant you were never actually at risk of dismissal, the good cause that would otherwise avoid the suspension period is missing. Upload your document and the critical points will be flagged, at no cost. Frequently asked questions
This depends on your employment contract. For positions covered by the EVG collective agreements, the group describes comprehensive protection against dismissal, with job cuts handled through staff turnover, partial retirement, severance pay, and the internal job market. Outside this scope, for example in non-tariff positions or group companies with their own rules, this protection does not apply automatically. So first check which collective agreement applies to your contract, and get written confirmation of your specific protection before discussing any termination.
According to the central works council, around 1,400 of the 6,700 full-time positions at IT subsidiary DB Systel are set to go, nearly one in five. Frankfurt is the focus, where, according to Deutsche Bahn, around 4,100 of the 6,700 employees work; the EVG union has also protested in Berlin and Erfurt. Deutsche Bahn itself has not confirmed any job-cut figures and says the group wants to become leaner, faster, and more customer-focused (hessenschau, February 2026). For those affected, this means figures and actual name lists are two different things. Until a reconciliation of interests (Interessenausgleich) is agreed, it is not yet clear who is affected.
This figure comes from DB Systel’s central works council, describing the entire group, not a figure from Deutsche Bahn itself. The group names no target figure at all, instead describing a socially responsible restructuring focused on overhead functions, and says the process ran as planned in the first half of 2026. What is confirmed, and named by the supervisory board chairman, is the at least 30% cut in group management, affecting around 3,500 people. For your own decision, do not rely on group-wide totals, rely on what has actually been negotiated for your specific area.
First clarify the key question: could you even be dismissed at all? If you fall under the EVG collective agreements’ protection against dismissal, you can decide without any pressure, and rushing is your biggest risk. Also work out the alternative: placement through the internal job market or “Job-Neustart” preserves your length of service, allowances, and company pension, all of which a severance payment ends for good. An offer that looks generous is not automatically the better deal.
A termination agreement (Aufhebungsvertrag) can trigger a twelve-week benefit suspension period (Sperrzeit) under § 159 SGB III if no good cause is documented. If your employment ends before the statutory notice period under § 622 BGB expires, your entitlement is also suspended under § 158 SGB III. Both can be managed through how the agreement is worded. This is especially critical at Deutsche Bahn: if your position carries collective-agreement protection against dismissal, you were never actually at risk of dismissal, meaning the good cause that would otherwise avoid the suspension period is missing.
The initial consultation comes at no cost. If you instruct us, we work on a success basis through litigation funding, so you carry no upfront financial risk.
